Afgelopen vrijdag is Google aangeklaagd door pornobedrijf Perfect10 voor het aanbieden van foto’s waarop auteursrecht zit. De foto’s zouden indirect in de zoekresultaten terecht zijn gekomen als gevolg van plaatsing op illegale websites.<\/p>\n

Het opmerkelijke aan deze zaak is dat Google niet aangeklaagd wordt voor content in betaalde posities, waarin Google inmiddels al een aantal juridische procedures heeft lopen (en ook heeft verloren), maar wordt aangeklaagd voor content in de zoekresultaten. Iets waarvan Google altijd heeft aangegeven daar niet verantwoordelijk voor te zijn. Opmerkelijk is verder ook dat de advocaten van Perfect10 een proces willen met een jury.<\/p>\n

De uitkomst van deze zaak kan dus cruciaal zijn voor zoekmachines in het algemeen. Het zou dus in het negatieve geval kunnen betekenen dat zoekmachines speciale maatregelen moeten nemen om illegale content te weren uit zoekmachines, iets dat nagenoeg onmogelijk is.<\/p>\n

Een zwak punt, in mijn ogen, is echter de formulering dat Google er financieel beter van wordt dat deze inhoud in de zoekmachine staat. Dat lijkt me sterk. Google verdient niets extra aan deze inhoud.<\/p>\n
